Terms of Service

Gatherly is a software-as-a-service product that helps freelancers create, publish, and manage client intake and project forms. The service includes authenticated dashboard tools for freelancers and public form links that clients can open without creating a Gatherly account.

These Terms of Service describe the rules for using Gatherly. By accessing or using Gatherly, you agree to these terms. If you use Gatherly on behalf of a business or client, you represent that you have authority to accept these terms for that organization.

Freelancers are responsible for maintaining the security of their account, dashboard access, and connected authentication methods. You are responsible for activity that happens through your account unless the activity is caused by Gatherly's failure to apply reasonable security measures.

You agree to provide accurate account information and to keep your account access limited to people who are authorized to manage your projects, forms, submissions, billing, and settings.

Gatherly lets you create client-facing forms and share public form links. Clients can use those public links without signing in to Gatherly. You are responsible for the form fields, instructions, branding, files requested, and other content you publish through those links.

You are responsible for making sure you have a lawful reason and any required notices or permissions before collecting personal information, files, project details, approvals, or other client data through Gatherly forms.

You should not use Gatherly to collect highly sensitive information unless you have independently determined that your use of Gatherly is appropriate for that data and that you can meet any legal or contractual requirements that apply to you.

Gatherly may store project data, form configuration, client responses, uploaded files, and related metadata so the service can display, organize, export, and notify you about submissions.

You retain responsibility for the content you and your clients submit. You represent that you have the rights needed to upload, store, process, and share that content through Gatherly.

Gatherly may include AI-assisted features that help draft project descriptions, form fields, or related content. AI-generated output may be incomplete, inaccurate, or unsuitable for your specific project.

You are responsible for reviewing, editing, and approving AI-generated content before relying on it or publishing it to clients. AI output is not professional, legal, financial, or business advice.

Gatherly may offer free and paid features, including Pro functionality such as increased limits, downloads, branding, or other premium capabilities. Paid features, prices, and limits may change over time.

Payments, checkout, subscriptions, taxes, refunds, and billing details may be handled by third-party payment providers. Your use of those payment services may be subject to the provider's own terms and policies.

You may cancel Pro at any time. If you cancel after the refund window, your subscription will not renew and you will retain Pro access until the end of your current paid billing period.

A full refund is available only when you cancel within seven days of your first successful Pro payment. Cancelling within that window ends Pro access immediately and requests the refund. Refunds are initiated immediately once approved, but may take 5 to 10 business days to appear on your statement depending on your payment method and bank.

You may not use Gatherly to violate laws, infringe rights, distribute malware, send abusive or deceptive content, attempt unauthorized access, interfere with the service, or collect data in a way that is unlawful or misleading.

You may not resell, reverse engineer, scrape, overload, or misuse Gatherly except where applicable law gives you a non-waivable right to do so.

We may suspend or terminate access to Gatherly if we reasonably believe your use violates these terms, creates security or legal risk, harms the service, or could harm other users or clients.

You may stop using Gatherly at any time. Some information may remain in backups, logs, billing records, or other records where retention is needed for security, legal, operational, or accounting reasons.

Gatherly is provided on an as-available basis. We may modify, add, remove, suspend, or discontinue features as the product evolves.

We may update these terms from time to time. When changes are material, we will take reasonable steps to notify users through the product, website, or another appropriate channel.

To the fullest extent permitted by law, Gatherly is provided without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the service will be uninterrupted, error-free, secure, or fit for a particular purpose.

To the fullest extent permitted by law, Gatherly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

These terms are drafted as a practical US-general SaaS template and should be reviewed before launch for the governing law and venue that apply to the final Gatherly operator.
